Law 14,300 in 2029: from the TUSD ladder to energy valuation

Post commented onPost by a third party: “Em 2029, a lógica de valoração da energia injetada pela geração distribuída muda no Brasil.” See the full post in the Linus publication ↗

Until 2028, the Law 14,300 transition charges an increasing percentage of the TUSD on compensated energy: 60% in 2026, 75% in 2027 and 90% in 2028. In 2029 the rule changes in nature: Article 17 replaces the ladder with a valuation of injected energy, taking time of day, seasonality and consumption profile into account.

The publication does not record that this rule does not yet exist in figures. The CNPE set the guidelines in Resolution No. 2 of 22 April 2024, but calculation of the benefits falls to ANEEL, which opened Call for Contributions 23/2025, with submissions until 4 March 2026, to discuss alternatives for applying Article 17.

A distributed generation project sold today with a payback of six to eight years crosses 2029 without knowing its revenue for the following period. Plant lease contracts, minigeneration PPAs and long-term financing are being signed on a premise that the regulator has not yet published.

The regulatory timeline open at ANEEL for the Article 17 calculation decides the value of the injected kWh from 2029 onwards.
