The low-emission hydrogen framework gets its institutional design

Until August 2026, the legal framework for low-emission hydrogen had a law but no institutional design. The publication records that the regulation organised this architecture, defining who regulates and who certifies, and points out that a timing question remains without a rule.

What is missing is the deadline for the procedure that distributes the benefit. Decree 13,096 of 12 August 2026, published in the Diário Oficial da União, provides for PHBC tax credits between 2030 and 2034, through competitive procedures run by the Ministry of Finance, with no date set for this selection.

A hydrogen project takes several years to build. If the selection that grants the credit has no date and drawdown starts in 2030, an investment decision taken now prices a benefit with an uncertain calendar, and long-term financing charges a premium for this uncertainty.

The calendar of the PHBC competitive procedure decides the present value of the incentive for those investing today.
